1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts for the purchase of goods that a consumer (§ 1(3) KSchG) enters into with us,

through our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

Any deviating, conflicting, or supplementary terms and conditions of the customer shall not become part of the contract unless their validity is expressly agreed to in writing.

2. Conclusion of the Contract

The presentation of the goods in the online shop does not constitute a binding offer. By clicking the “Place order” button, you submit a binding purchase offer.

The contract is not concluded until we accept your order by sending an order confirmation via email or ship the goods. We are entitled to reject orders without providing reasons (e.g., in cases of reasonable suspicion of misuse).

3. Prices and Payment Terms

All prices are quoted in euros and include the applicable value-added tax (VAT). Other taxes and fees are not included and will be shown separately.

Payment can be made via PayPal, credit card, Sofortüberweisung, Klarna, Apple Pay, or Google Pay. The purchase price is due immediately.

4. Delivery and Shipping

Delivery is made to the address you provided. Delivery times are non-binding unless expressly stated as binding.

The risk of accidental loss or accidental deterioration of the goods passes to you or your authorized representative upon delivery.

5. Right of Withdrawal (Right to Cancel)

6. Warranty / Liability for Defects

The statutory warranty provisions apply (§§ 922 ff ABGB in conjunction with KSchG). For new goods, the warranty period is 2 years from delivery.

You are initially entitled to subsequent performance (repair or replacement). If this fails, you may demand a price reduction or—in the case of significant defects—cancel the contract.

Special provisions for TCG products / booster packs / starter sets:

  • The merchandise is offered with condition descriptions customary in the industry (e.g., Near Mint, Lightly Played). These descriptions are decisive for the agreed-upon condition. Minor, typical variations (e.g., minimal printing misalignment, slight white edges, marks on the edges or corners) within the specified condition do not constitute a defect.
  • For sealed products, a defect exists only if the merchandise is already defective upon delivery (e.g., damaged packaging).
  • Once you have opened the seal, there is no longer any warranty claim for the contents (e.g., cards drawn), as the random nature of the draw (“random pulls”) is standard in the industry and does not constitute a defect.
  • You must inspect the goods immediately upon receipt and notify us of any obvious defects within a reasonable period of time (no later than 14 days after discovery) (E-Mail: grandlinecardsat@gmail.com).

7. Liability

We assume unlimited liability for damages resulting from willful misconduct or gross negligence, for personal injury, and under the Product Liability Act.

In all other respects, our liability is limited—to the extent permitted by law—to damages that were typically foreseeable at the time the contract was concluded.

We are liable for slight negligence only in the event of a breach of material contractual obligations (cardinal obligations).

8. Retention of Title

The goods remain our property until full payment has been made.

9. Intellectual Property

All content (photos, text, logos) is our property or licensed. Any use without consent is prohibited.

10. Data Protection

Our privacy policy applies.

11. Jurisdiction and Applicable Law

Austrian law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for all disputes arising from or in connection with this contract is the competent court at the registered office of our company.

12. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Severability clause

Should any provision be invalid, the remainder of the contract shall remain valid. 

14. Changes to the Terms and Conditions

We reserve the right to amend these Terms and Conditions. The current version is always available in the shop. We will notify you in a timely manner of any significant changes.
